PARTICIPANT AGREEMENT FORM
Course / Workshop / Mentorship Enrolment
1. LEGALITIES CLAUSE
1.1 By submitting this online Agreement, the Participant acknowledges and agrees that enrolment in any course, workshop, mentorship, event, or programme conducted by Toptier Institute is subject to the terms, policies, and conditions prescribed by Toptier Institute from time to time.
1.2 All fees paid, including deposits, booking fees, enrolment fees, online payments, and package payments, shall be subject to Toptier Institute's payment, administrative, cancellation, and refund policies. Unless otherwise expressly stated in writing by Toptier Institute, all payments made shall be strictly non-refundable and non-transferable.
1.3 Toptier Institute reserves the right to amend course schedules, class timings, instructors, programme structures, learning materials, support access, bonuses, and related arrangements where reasonably necessary for operational, administrative, educational, or safety purposes.
1.4 Classes are conducted face-to-face at Toptier Institute, 15 Hamilton Road, Singapore 209185, unless otherwise stated in writing by Toptier Institute. The Participant acknowledges that this is a face-to-face programme and that online or Zoom classes are not provided unless expressly stated by Toptier Institute.
1.5 Toptier Institute further reserves the right to reject, suspend, or remove any Participant from any course, session, event, online platform, or private community, without refund where appropriate, in the event of misconduct, disruptive behaviour, abusive conduct, breach of confidentiality, unauthorised recording, unauthorised sharing of materials, or any act deemed prejudicial to the interests, reputation, operations, staff, or participants of Toptier Institute.
1.6 All materials, frameworks, recordings, documents, slides, strategies, systems, branding, indicators, digital resources, and other intellectual property made available by Toptier Institute shall remain the sole and exclusive property of Toptier Institute unless otherwise expressly stated in writing. No Participant shall copy, reproduce, record, publish, distribute, transmit, resell, or otherwise share any such materials without the prior written consent of Toptier Institute.
1.7 To the fullest extent permitted by law, Toptier Institute shall not be liable for any direct, indirect, incidental, consequential, commercial, financial, or reputational loss arising out of or in connection with participation in its courses, programmes, events, services, materials, private communities, digital platforms, or communications.
1.8 This Agreement shall be governed by and construed in accordance with the laws of Singapore.
1.9 The Participant hereby grants Toptier Institute and its authorised representatives consent to photograph, film, record, and capture the Participant's image, likeness, voice, and appearance during any course, workshop, mentorship, event, programme, online session, or related Toptier Institute activity. The Participant further consents to Toptier Institute's use of such photographs, videos, recordings, and related content for marketing, promotional, educational, social media, website, or digital media purposes, including but not limited to publication on Toptier Institute's website, Instagram, TikTok, Facebook, YouTube, Telegram, WhatsApp, and other digital or print media, without any obligation to notify, compensate, or seek further approval from the Participant.
2. DISCLAIMER CLAUSE
2.1 The Participant expressly acknowledges and agrees that Toptier Institute is an education provider only. All content, materials, discussions, strategies, charts, case studies, market commentary, examples, and information shared by Toptier Institute are provided strictly for educational and informational purposes only.
2.2 Nothing provided by Toptier Institute shall be construed as financial, investment, legal, tax, or professional advice, nor as a solicitation, recommendation, or inducement to buy, sell, hold, or trade any financial instrument, security, or product.
2.3 Toptier Institute does not provide personalised investment advice, guaranteed trade calls, guaranteed profits, or guaranteed performance outcomes. Any examples, illustrations, demonstrations, or case studies presented during any course, workshop, mentorship, marketing material, online material, or communication are purely illustrative in nature and shall not constitute any promise, representation, or guarantee of future results.
2.4 The Participant understands and accepts that trading and investing involve substantial risk, and that past performance is not indicative of future performance. All trading, investment, and financial decisions made by the Participant shall be made solely at the Participant's own discretion, judgment, and risk.
2.5 The Participant further agrees that Toptier Institute shall not be held responsible or liable for any loss, damage, liability, cost, or expense incurred directly or indirectly as a result of reliance on any content, materials, sessions, commentary, examples, digital resources, or services provided by Toptier Institute.
2.6 Any testimonials, success stories, profit screenshots, trading results, or performance figures displayed in Toptier Institute's marketing materials, social media, website, online platforms, or during any session are individual results only. They are not typical, are not guaranteed, and shall not be interpreted as a representation of what any Participant may achieve. Individual outcomes will vary based on personal effort, market conditions, capital, discipline, and experience.
2.7 Toptier Institute may from time to time reference, recommend, or discuss third-party platforms, brokers, tools, applications, or services during its programmes. Such references are for educational illustration purposes only. Toptier Institute does not endorse, certify, or accept responsibility for any third-party platform, broker, tool, or service, and shall not be held liable for any loss, damage, or dispute arising from the Participant's use of or reliance on any such third party.
2.8 All content, strategies, frameworks, and market commentary delivered by Toptier Institute reflect conditions and analysis at the time of delivery. Financial markets are inherently dynamic and unpredictable. Toptier Institute makes no representation that any strategy, methodology, or analysis taught will remain applicable, relevant, or effective under future market conditions.
2.9 Any communications made by Toptier Institute's instructors, mentors, staff, or representatives through WhatsApp, Telegram, Instagram, TikTok, YouTube, email, website, online platforms, or any other communication channel, whether in written, verbal, or recorded form, are strictly for educational and informational purposes only. Such communications shall not constitute financial advice, personalised investment recommendations, or any form of regulated financial service, regardless of the nature or content of the message.
2.10 The Participant confirms that prior to enrolment, they have conducted their own independent due diligence regarding the suitability of the programme for their personal circumstances, financial situation, and objectives. The Participant acknowledges that they have not relied solely upon any verbal representations, promotional materials, or communications made outside of this written Agreement in making their enrolment decision.
3. ONLINE CONSENT AND ACKNOWLEDGEMENT
3.1 By ticking the checkbox and submitting this form, the Participant confirms that they have read, understood, and agreed to this Participant Agreement.
3.2 The Participant acknowledges that this online submission shall serve as their electronic acknowledgement and agreement.
3.3 The Participant understands that access to Toptier Institute's programme, materials, online resources, private communities, onboarding instructions, or related services may be withheld until this Agreement is completed and submitted.
3.4 The Participant confirms that all information submitted in this form is true and accurate to the best of their knowledge.
